How defence manufacturers can obtain the economically critical status

The Ministry of Defence has approved clear criteria to designate defence, aircraft and space companies as critical to the national economy. The decision was formalised in MoD Order No. 722 of 28 October 2025.

The criteria identify enterprises that may be designated as critical to the national economy. This designation provides the basis for reserving personnel liable to military service during mobilisation and wartime, pursuant to Government Resolution No. 76 of 27 January 2023.

Applications and accompanying documents must be submitted to admou@post.mil.gov.ua. The email must bear a qualified electronic signature.

To ensure transparency and user convenience, the Ministry of Defence has prepared detailed step-by-step submission algorithms, along with the sample document templates provided below.

How to Submit Documents

OPTION 1

Algorithm 1 – For government contractors (eligible to reserve up to 100% of employees)

1. Prepare statements regarding:

  • active government contracts under which your enterprise delivers defence work or products (Appendix 1), and
  • defence products, works or services delivered in the latest reporting period (Appendix 3).

2. Have those documents approved, signed, and stamped by the government customer.

3. Prepare a letter of application to the Ministry of Defence, specifying:

  • the entity code, legal address, and primary activities of your enterprise,
  • the director’s full name and the contact details of your enterprise,
  • the clauses of the Government Resolution No. 76 under which your enterprise is applying for the critical status, and
  • a statement on the total number of reservable employees who are liable to military service.

4. Enclose the approved statements and one of the documents from the list below that confirms your enterprise’s financial activities:

  • a Profit and Loss Statement (Form 2) or, for state-owned companies, a Financial Plan Progress Report, or
  • an Industrial Production Report (Form 1-P or 1P-NPP) as issued by the State Statistics Service.

Algorithm 2 – For government subcontractors

1. Prepare statements regarding:

  • engagement in performing a government contract (Appendix 2), and
  • defence supplies or services (Appendix 3).

2. Have those documents approved, signed, and stamped by both the main contractor and the government customer.

3. Send a letter of application to the Ministry of Defence, specifying the entity code, contact details and business activities of your enterprise, and the applicable clauses of Government Resolution No. 76, and enclose the approved documents; please also send a statement on the total number of reservable employees who are liable to military service.

4. Enclose a financial statement (Form 2) or statistical report for the latest reporting period.

OPTION 2

For grantee enterprises

A company awarded state support in the form of a grant for the development of defence related innovations and technologies must provide:

  • a certified copy of the grant contract with the Innovation Development Fund,
  • proof of having received the grant proceeds — either a payment receipt or a bank statement confirming the transfer from the grantor, and
  • a statement on the total number of reservable employees who are liable to military service.

OPTION 3

For Defence City residents

An enterprise must submit a formal application together with a copy of the Defence City residency awarding order.

OPTION 4

For enterprises with the status of explosives manufacturers

To prove compliance with the criterion, a company, institution, or organisation must provide:

  • a copy of the relevant joint decision specifying a deadline for completing its development and/or production of explosives, and
  • proof of having obtained the manufacturer status and the right to produce and supply explosives and ammunition for the Ukrainian Security and Defence Forces.

OPTION 5

For defence, aircraft and space enterprises (eligible to reserve up to 50% of employees)

1. Determine which three of the six criteria set out in Ministry of Defence Order No. 722 apply to your enterprise (e.g., participation in government contracts or programmes, or defence manufacturing operations).

2. Prepare supporting documents:

  • statements or letters from the government customer, programme implementer, or defence enterprise, and
  • copies of the contracts or orders evidencing the participation in the operations or programmes.

3. Have those documents approved, signed, and stamped by the customer or enterprise concerned.

4. To further designate your enterprise as critical to the operation of the economy and the provision of essential services during a special period (subject to Resolution No. 76), your company must also demonstrate compliance with two additional criteria set out in that Resolution. This is because designation as critical to the national economy is only one of the criteria specified therein.

5. Send a letter of application to the Ministry of Defence, together with the entity code and contact details of your enterprise, a description of its activities, and the enclosed documents.

After the documents have been reviewed, the MoD working group will decide whether your enterprise meets the criteria. This decision will provide the basis for subsequent employee reservations in accordance with Government Resolution No. 76.
